These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at www.webhost11.com (together or individually “Service”) managed by OVN Technologies.

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood the Agreements and agree to be bound by them.

2. Communications

3. Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to provide information relevant to your Purchase, including but not limited to your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and (ii) the information you supply is true, correct, and complete.

We may employ third-party services to facilitate payment and complete Purchases. By submitting your information, you grant us the right to provide it to these third parties, subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product or service availability, errors in the description or price, errors in your order, or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

4. Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or other promotions (collectively, “Promotions”) made available through the Service may be governed by rules separate from these Terms. If you participate in any Promotions, please review the applicable rules and our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

5. Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles depend on the subscription plan you select.

Your Subscription will automatically renew under the same conditions unless you or OVN Technologies cancels it. You may cancel your Subscription renewal through your online account management page or by contacting our customer support team at info@webhost11.com.

A valid payment method is required to process Subscription payments. You shall provide OVN Technologies with accurate and complete billing information, including but not limited to full name, address, state, postal or zip code, telephone number, and valid payment method information. By submitting such information, you authorize OVN Technologies to charge all Subscription fees to the provided payment method.

If automatic billing fails for any reason, OVN Technologies reserves the right to terminate your access to the Service with immediate effect.

6. Free Trial

OVN Technologies may, at its sole discretion, offer a Subscription with a free trial for a limited period (“Free Trial”).

You may be required to enter billing information to sign up for a Free Trial. If you provide billing information, you will not be charged until the Free Trial expires. On the last day of the Free Trial, unless you cancel your Subscription, you will be automatically charged the applicable Subscription fees for the selected plan.

OVN Technologies reserves the right to (i) modify the Terms of Service for the Free Trial offer or (ii) cancel the Free Trial offer at any time without notice.

7. Fee Changes

OVN Technologies may modify Subscription fees at its sole discretion. Any fee changes will take effect at the end of the then-current Billing Cycle.

We will provide reasonable prior notice of any fee changes, allowing you to terminate your Subscription before the change takes effect. Your continued use of the Service after a fee change constitutes your agreement to pay the modified amount.

8. Refunds

Refunds for Contracts are issued within 30 days of the original purchase of the Contract.

9. Content

Our Service allows you to post, link, store, share, and otherwise make available information, text, graphics, videos, or other material (“Content”). You are responsible for the Content you post, including its legality, reliability, and appropriateness.

By posting Content, you represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms; and (ii) posting your Content does not violate privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity. We reserve the right to terminate the account of anyone found infringing on a copyright.

You retain all rights to your Content, and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content posted by you or any third party. By posting Content, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. This license includes the right for us to make your Content available to other users, who may also use it subject to these Terms.

OVN Technologies has the right, but not the obligation, to monitor and edit Content provided by users. Content found on or through the Service is the property of OVN Technologies or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, in whole or in part, for commercial purposes or personal gain without our express written permission.

10. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

Additionally, you agree not to:

• Attack the Service via a denial-of-service attack or distributed denial-of-service attack.
• Take any action that may damage or falsify the Company’s rating.
• Otherwise attempt to interfere with the proper working of the Service.

We may use third-party Service Providers to monitor and analyze the use of our Service.

12. No Use By Minors

The Service is intended for access and use by individuals at least eighteen (18) years old. By accessing or using the Service, you warrant that you are at least eighteen (18) years of age and have the full authority, right, and capacity to enter into this agreement and abide by these Terms. When creating an account, you guarantee that you are over 18 and that the information you provide is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in immediate account termination.

You are responsible for maintaining the confidentiality of your account and password and restricting access to your computer and/or account. You accept responsibility for all activities under your account or password, whether with our Service or a third-party service. You must notify us immediately at info@webhost11.com upon becoming aware of any security breach or unauthorized use of your account.

You may not use a username that is the name of another person or entity, not lawfully available for use, or subject to the rights of another person or entity without authorization. Usernames that are offensive, vulgar, or obscene are prohibited.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

The Service and its original content (excluding user-provided Content), features, and functionality are and will remain the exclusive property of OVN Technologies and its licensors. The Service is protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks may not be used in connection with any product or service without the prior written consent of OVN Technologies.

15. Copyright Policy

We respect the intellectual property rights of others. It is our policy to respond to claims that Content posted on the Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner or authorized representative and believe that copyrighted work has been copied in a way that constitutes infringement, please submit your claim via email to info@webhost11.com with the subject line: “Copyright Infringement.” Include a detailed description of the alleged Infringement as outlined in the “DMCA Notice and Procedure for Copyright Infringement Claims” below.

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims regarding the infringement of any Content.

16. DMCA Notice and Procedure for Copyright Infringement Claims

If ownership transfer of Feedback is not possible due to applicable laws, you grant OVN Technologies and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited, and perpetual right to use (including copy, modify, create derivative works, publish, distribute, and commercialize) Feedback for any purpose.

OVN Technologies has no control over and assumes no responsibility for the content, privacy policies, or practices of third-party websites or services. We do not warrant the offerings of these entities or their websites.

YOU ACKNOWLEDGE AND AGREE THAT OVN TECHNOLOGIES SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH THE USE OF OR RELIANCE ON ANY CONTENT, GOODS, OR SERVICES AVAILABLE ON OR THROUGH THIRD-PARTY WEBSITES OR SERVICES.

19. Disclaimer of Warranty

THESE SERVICES ARE PROVIDED BY OVN TECHNOLOGIES ON AN “AS IS” AND “AS AVAILABLE” BASIS. OVN TECHNOLOGIES MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.

NEITHER OVN TECHNOLOGIES NOR ANY PERSON ASSOCIATED WITH OVN TECHNOLOGIES MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. WITHOUT LIMITING THE FOREGOING, NEITHER OVN TECHNOLOGIES NOR ANYONE ASSOCIATED WITH OVN TECHNOLOGIES REPRESENTS OR WARRANTS THAT THE SERVICES, THEIR CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES WILL MEET YOUR NEEDS OR EXPECTATIONS.

OVN TECHNOLOGIES DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

20. Limitation of Liability

EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD OVN TECHNOLOGIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEYS’ FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF OVN TECHNOLOGIES HAS BEEN PREVIOUSLY ADVISED малого OF THE POSSIBILITY OF SUCH DAMAGE.

EXCEPT AS PROHIBITED BY LAW, IF LIABILITY IS FOUND ON THE PART OF OVN TECHNOLOGIES, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

21. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may discontinue using the Service.

All provisions of these Terms that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

22. Governing Law

These Terms shall be governed and construed in accordance with the laws of Karnataka, India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede any prior agreements.

23. Changes to Service

We reserve the right to withdraw or amend our Service, and any service or material provided via the Service, at our sole discretion without notice. We will not be liable if all or any part of the Service is unavailable at any time or for any period. We may restrict access to some parts or the entire Service to users, including registered users, from time to time.
